The Court of appeal sitting in Abuja has set aside the Governorship Election Petition Tribunal’s judgment which nullified Governor Gboyega Oyetola’s victory in the Osun governorship election.

In three separate appeals filed by Oyetola, the All Progressives Congress and the Independent National Electoral Commission, the appellate court was asked to set aside the 22 March, 2019 judgement of the tribunal which declared Senator Ademola Adeleke as winner. The Appeal court has now affirmed Oyetola’s election as declared by the Independent National Electoral Commission.

Meanwhile, the chairman, Osun State chapter of the Peoples Democratic Party, Mr Soji Adagunodo, says the party would appeal the judgement of the Appeal panel. Adagunodo said the panel relied on a technicality in giving its decision.

“Technicality was what Wole Olanipekun laid before the court. There was no argument about the decision of the Tribunal that gave us victory. We will upturn the judgement at the Supreme Court. It is democracy at play. We will study the Appeal Court judgment appropriately and challenge it at the supreme court,” Adagunodo said.

INEC had declared Oyetola and the APC the winner of the Osun State governorship election on the basis of the cumulative results of the September 22, 2018, main election and the September 27, 2018, supplementary poll. Dissatisfied with the result declared by INEC, the PDP and Adeleke had filed their petition before the three-man Osun State Governorship Election Petition Tribunal, contending that they were the true winner of the election as they had already won after the September 22, 2018 poll and that there was no need for the supplementary election held on September 27, 2018.
